The Bookabucket terms and conditions details the Bookabucket’s and users’ responsibilities, duties, actions and outcomes on the Bookabucket Platform.

 

By accessing the platform, you consent to our Terms and Conditions as contained herein.  We reserve the right to amend our User agreement at anytime by communicating the amended terms on the Platform without prior notice to you.

 

Definitions:

"Account" means the account associated with your email address as created on the bookabucket platform

"User""you" or "your" means anyone visiting or using the Platform including through an API

"Filler" means a User that posts a task

"Bucketer" means a User that has been verified to execute tasks.

"Bookabucket""we""our""company" or "the company" or "us" means Bookabucket and Supplies Limited.

"Confirmation Icons" means the icons available to be displayed on a User's profile and any such posts on the Platform to confirm details such as a Police Background check

"Task" means a requested service/product that is posted by a filler for Bucketers to bid that may include any variations or amendments agreed before or subsequent to the Task assignment.

"Task Description" means the full description of the requested service or product, which may include but not limited to Location, images, delivery timeline etc.

"Published Task" means a filler’s task that is available on the platform for bidding by Bucketers

"Assigned Task” means a filler’s task that has been allocated to the preferred Bucketer. 

"Offer" means the submission of the amount a Bucketer chooses to supply the service/product to the filler on a specific task

"Task Agreement" means the contract, which is formed between a Filler and a Bucketer for an assigned task. In the absence of, or in addition to, any terms specifically agreed, the model terms of which are included in Appendix A to the Agreement apply to Task Contracts.

"Issue Resolution Process" means the defined process to be followed by Fillers and Bucketers as provided by BookABucket or any third party Issue Resolution Partner.

"Intellectual Property Rights" means any and all intellectual property rights, existing worldwide and the subject matter of such rights, including: (a) patents, copyright, rights in circuit layouts (or similar rights), registered designs, registered and unregistered trademarks, and any right to have confidential information kept confidential; and (b) any application or right to apply for registration of any of the rights referred to in paragraph (a), whether or not such rights are registered or capable of being registered and whether existing under any laws, at common law or in equity.

“Task Budget” means the amount the filler specifies to be paid to a bucketer for a task upon completion of same task.

"Payment Account" means the holding account to which a filler must make the full payment for the task before the task may be published.

"Bucketer Skills" means all services provided by a Bucketer

“Bucketer Charge” means the fee payable by the Bucketer to Bookabucket as consideration for the Bookabucket Services (and comprised as part of the Offer) displayed to a Filler prior to assigning a task.

 "Bucketer earnings" means the Agreed Price less of the Bucketer Charge payable to a bucketer upon satisfactory completion of a task.

"Bookabucket Services" means all services provided by us to you.

"Service Fee" means the fee payable by the Filler to Bookabucket as consideration for the Bookabucket Services (and comprised as part of the Agreed Price) displayed to a Filler prior to assigning a task.

“Wallet Value” means the virtual card or code containing credit or a discount or refund provided as credit or anything else identified or described as 'Wallet Value' in this Agreement, for use on the Bookabucket Platform.

"User Agreement" means: (1) this Terms and Conditions; (2) any other contractual provisions accepted by both the Filler and Bucketer uploaded to the Platform, to the extent that it is consistent with the Terms and Conditions; (3) the Task terms as assigned and accepted on the Platform, to the extent that it is consistent with the Terms and Conditions; and (4) any other material updated or newly incorporated on the platform.

"Non-excludable Condition" means any implied condition, warranty or guarantee in a contract, the exclusion of which would contravene the law or cause any part of the contract to be void.

"Platform" means the Platform operated by Bookabucket and available at: bookabucket.com and any of its regional or other domains or properties, and any related Bookabucket service, tool or application, specifically including mobile web, any iOS App and any Android App, or API or other access mechanism.

 

 

Overview

The Platform is an online community that connects fillers requiring tasks to be executed with Bucketers who have the capacity to execute the tasks. We aren’t a party to the task contract between the Filler and the Bucketer on the platform, we only enable connections between the parties. All fillers and Bucketers are required to have accounts before they post, bid and assign tasks on the platform.

 

1.   BOOKABUCKET Roles and Obligations

BookaBucket provides the Platform only, to enable Users publish Tasks and make offers on Published Tasks

Before creating your account on the platform you must read and agree to the User agreement and all related platform policies. Upon acceptance of the User agreement and all related platform policies, you agree that this agreement and its amendments will apply whenever you use the platform or any tools provided via the platform.

 

Platform Eligibility

       I.         You are eligible to use the platform if:

     II.         You are 18years and above

    III.         You have the work permit and authorisation to provide such skills and services according to the laws that govern the Federal Republic of Nigeria

   IV.         You have a valid phone number

    V.         You have a valid email address

 

Creating an account on Bookabucket is free.

 

User accounts are connected to unique individuals. The individual associated with an account will be held responsible for all actions taken by the account, without limitation. Your Login credentials should not be shared with anyone else. 

Company or Business names may be provided by users and would be associated with the User’s Account. Users consent and agree that where a business name or company name is associated with their Account, the User Agreement is with the User as an individual (not the business or company) and Users remain solely responsible for all activity undertaken in respect of their Account.

User rights or obligations under the User Agreement are non-transferable without prior written authorization.

 

At its absolute discretion, we may refuse to allow any person to register or create an account on the Platform or cancel or suspend an existing account.

 

We accept no liability for any aspect of the Filler and Bucketer interaction, including but not limited to the description, performance or delivery of Services

 

We have no responsibility and make no warranty as to the truth or accuracy of any aspect of any information provided by Users, including, but not limited to, the ability of Bucketers to perform tasks or supply items, or the honesty or accuracy of any information provided by Fillers.

 

We have no obligation to any User to assist or be involved in any dispute between Users, although we may do so to improve User experience.

 

2.   SCOPE OF BOOKABUCKET SERVICES

·       Bookabucket provides the Platform to enable Fillers to publish Tasks.

  • Upon creation of a Task, the Filler must pay the Agreed Price into the Payment Account, before the task may be published.
  • Bucketers may make an Offer in response to a Published Task. Some parts of Offer details may be made publicly available for promotional purposes, including to internet users who are not Users.
  • A  Filler may cancel or modify a Published Task at any time before he/she assigns the task to the preferred Bucketer. We reserve the right to cancel all Offers on a Published Task made preceding the modification or amendment.
  • If a Filler assigns a task on the Platform and the Bucketer accepts the task, the Task Agreement of Bookabucket immediately takes effect between the Filler and the Bucketer.
  • Bookabucket has rendered its services and the Service Fee is due, payable and non-refundable once a task is published.
  • A created Task Agreement may be reviewed and/or modified by the Filler and the assigned Bucketer. All variations and modifications to the Task Agreement (Including Agreed Price) must be communicated to Bookabucket  via any of the available communication channels i.e Platform messaging, email or phone call.
  • The Bucketer must perform the Services with compliance to the Task Agreement, including in accordance with any additional terms or conditions agreed by the parties.
  • Upon completion of the Task, the Bucketer must provide completion notice on the Bookabucket Platform
  • Upon the provision of notification by the Bucketer, the Filler must provide completion confirmation on the platform.
  • Once the Bucketer has completed the Assigned Task and Filler has confirmed completion, the Bucketer Earnings will be released from the Payment Account.
  • Once the Published Task is closed, the Filler must review the Bucketer so as to have access to creating a Task. A Bucketer may review a Filler.

 

3.   User Obligations

3.1.   While using the Platform, you agree that you will always

                         I.         Comply with this User Agreement (including all other policies, frameworks etc) and all applicable laws and regulations;

                       II.         Maintain control of your account;

                      III.         Post only true and correct information on the Platform;

                     IV.         Promptly and professionally perform your required commitments to other User under a Task Agreement;

                      V.         As a Bucketer or Filler, ensure that you are abreast of any laws that apply to You, or in relation to using the Bookabucket Platform;

                     VI.         Deliver payment for services delivered to you;

                    VII.         Deliver Bucketer Services purchased from you;

 

3.2.   Without limiting any provision of this Agreement, any information You supply to Bookabucket or publish in a Published Task (including as part of an Offer) must be up to date and kept up to date and must not:

                         I.         Be false, inaccurate, misleading, deceptive, defamatory or offensive content (including personal information);

                       II.         Be fraudulent or involve the sale of counterfeit or stolen items;

                      III.         Infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or intellectual property rights, rights of publicity, confidentiality or privacy;

                     IV.         Violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export and import control, consumer protection, unfair competition, criminal law, antidiscrimination and trade practices/fair trading laws);

                      V.         Be defamatory, libellous, threatening or harassing;

                     VI.         Be obscene or contain any material that, in Bookabucket's sole and absolute discretion, is in any way inappropriate or unlawful, including, but not limited to obscene, inappropriate or unlawful images; or

                    VII.         contain any malicious code, data or set of instructions that intentionally or unintentionally causes harm or subverts the intended function of any Airtasker Platform, including, but not limited to viruses, trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or Personal Information.

 

3.3.   While using the Platform, you agree that you will not

                         I.         Post content or items in inappropriate categories or areas on the platform

                       II.         Distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes

                      III.         Circumvent or manipulate our fee structure, the billing process, or fees owed to Bookabucket

                     IV.         Use the Bookabucket Platform for any illegal or immoral purpose.

                      V.         Use any content (whether provided by BookABucket, a User or a third party) on the Platform on third party sites or for other business purposes without Bookabucket's prior permission.

                     VI.         Deal your account in any way, including by allowing others to use your account, or by transferring or selling Your account or any of its content to another person.

                    VII.         Take any action that may undermine the feedback or reputation systems (such as displaying, importing or exporting feedback information or using it for purposes unrelated to the Platform);

                   VIII.         Download and aggregate listings from our platform for display with listings from other websites without our express written permission, "frame", "mirror" or otherwise incorporate any part of the Platform into any other website without our prior written authorisation;

                     IX.         Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by us in connection with the Platform;

                       X.         Copy, modify or distribute rights or content from the Platform or Bookabucket's copyrights and trademarks;

                     XI.         Extract or otherwise collect information about Users, including email addresses, without their written consent;

                    XII.         Use Bookabucket to facilitate money exchange including, but not limited to, cryptocurrency (e.g. Bitcoin, Ethereum, etc).

3.4.   You grant Bookabucket an unrestricted, worldwide, royalty-free license to use, reproduce, modify and adapt any content and information posted on the Platform for the purpose of publishing material on the Platform and as otherwise may be required to provide the BookABucket Service, for the general promotion of the Bookabcket Service, and as permitted by this Agreement.

3.5.   Bookabucket services engage location-based or map-based functionality. The Platform may display the location of Fillers and Taskers to persons browsing the Platform. Each Filler will be asked to provide the full address where the Services are to be delivered. A Filler should never disclose personal details such as the Filler's full name, street number, phone number or email address in a Posted Task or in any other public communication on the Platform.

3.6.   When supplying Services, you must not charge a Filler any fees on top of the Bucketer Charge. However, the parties to a Task Agreement may both decide to amend the Agreed Price through the Bucketer Platform.

3.7.   In handling a task, if there is need to pay some costs of completing the task (such as material purchases, equipment purchase/rental) and a filler agrees to pay this fee, the Bucketer is solely responsible for obtaining any reimbursement/ funds from the Bucketer. Bookabucket advises bucketers not to agree to incur costs in advance of receiving the payment for these costs, unless the Bucketer is confident the Filler will reimburse the costs promptly.

3.8.   Bucketer must not request payments outside of the Bucketer Platform from the Filler except to the extent permitted by clause 3.7 and only if the Bucketer Platform does not facilitate the reimbursement via the Payment Account of costs considered in clause 3.7.

3.9.   For the proper operation of the Platform, if the Bucketer must subcontract any part of the task to a third party in accordance with the task agreement, then the bucketer must ensure that the third party must also be a registered User of the Platform.

3.10. If Bookabucket determines at its sole discretion that You have breached any obligation under this clause 3, it reserves the rights to remove any content, Posted Task or Offer You have submitted to the Bookabucket Service or cancel or suspend Your account and/or any Task Agreements.

 

4.   FEES

4.1.   Upon the creation of a Task Agreement, the Bucketer owes BookABucket the Bucketer Charge. The Bucketer Charge will automatically be deducted from the Agreed Price held in the Payment Account.

4.2.   If the Published Task requires a Bucketer to incur costs in completing the Services as specified in Clause 3.6, the cost incurred will not be included in any calculation of Fees on the Bookabucket Platform.

4.3.   Fees do not include any fees that may be due to Third Party Service providers.

4.4.   All Service Fees and Bucketer charges payable to Bookabucket are non-cancellable and non-refundable.

4.5.    Fees applying to any new service launched by Bookabucket on the Platform is payable upon the launch of the service.

4.6.   Bookabucket may restrict a User’s account until all Fees and charges have been paid.

 

5.   PAYMENTS AND REFUNDS

5.1  If a published task is cancelled for any reason by a Filler prior to assigning a task, and then BookAbucket is reasonably satisfied that the Task Budget should be returned to the Filler then the Task Budget will be refunded to the Filler as Wallet Value and the Service Fee will remain non-refundable to the Filler.

5.2  Any amount returned by Bookabucket to a Filler on behalf of a Bucketer under clause 5.1 will be a debt owed by the Bucketer to Bookabucket and may be offset by Bookabucket against any other payments owed at any time to the Bucketer.

5.3  Cancellation of a Task Agreement will be attributable to the Bucketer where:

a.    the Filler and the Bucketer mutually agree to cancel the Task Agreement; or

b.    following reasonable but unsuccessful attempts by a Filler to contact a Bucketer to perform the Task Agreement, the Task Agreement is cancelled by the Filler; or

c.    a Task Agreement is cancelled in accordance with clause 3.10 as a result of the Bucketer’s actions or breach.

5.4  A Cancellation of a Task Contract will be attributable to a Filler where:

o   (a) the Filler cancels the Task Agreement (other than in accordance with clause 5.4(b); or

o   (b) a Task Contract is cancelled in accordance with clause 3.10 as a result of the Filler’s actions or breach..

5.5  If the parties agree to any additional fee payable under the Task Agreement in accordance with clause 3.7, it is the responsibility of the party aggrieved to claim any amount owed directly from the other.

5.6  BookABucket may take up to 14 days to return the refund amount which is the task budget (less the Service  Fee) to the Filler.

5.7  If, for any reason, the Bucketer Charge cannot be transferred or otherwise made to the Bucketer or returned to the Filler (as the case may be) or no claim is otherwise made for the Bucketer Charge, the Bucketer Charge will remain in the Payment Account until paid or otherwise for up to three months from the date the Filler initially paid the Task Budget into the Payment Account.

5.8   Following the 3 months referred to in clause 5.8, and provided there is still no dispute in respect of the Bucketer Charge, the Bucketer Charge will be credited to the Filler as Wallet Value.

5.9    If the Task Agreement is cancelled and a User who is party to the Task Agreement can show that work under a Task Agreement was commenced and has billable charges, then the amount of the Task Budget to be returned to the Filler will be conditional upon the mediation and dispute process. However, the Service Fee will always be deducted in accordance with clause 5.1.

6.   WALLET VALUE

6.1   Wallet Value :

a.    can be used by the credited User to pay for any new Services via the Bookabucket Platform;

b.    are not refundable or redeemable for cash;

c.    cannot be replaced, exchanged or reloaded or transferred to another account

d.    are valid for 12 months from the date on which that particular Wallet Value is applied to a User's account, the date of issue or purchase or any expiry date applied by Bookabucket;

e.    must not be reproduced, copied, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the credited User, or stored in a data retrieval system, without Bookabucket's prior written permission.

6.2   The User credited with a Wallet Value is solely responsible for the security of any wallet Value. Save for the Non-Excludable Conditions, BookABucket will have no liability for any loss or damage to the Wallet Value and does not have any obligation to replace Wallet Value.

6.3   Bookabucket will not accept, and may refuse or cancel, any Wallet Value, which it reasonably determines in its discretion, have been used in breach of this Agreement or have been forged, tampered with, or are otherwise fraudulent and Airtasker reserves the right to refer any suspected fraudulent activity to relevant law enforcement authorities.

6.4   Bookabucket is entitled to any value on Wallet Value which is not redeemed before the Stored Value expires or is cancelled by Bookabucket.

 

7.   PAYMENT FACILITY

7.1   Bookabucket has engaged a Payment Provider to operate the Payment Account and functions of the platform.

7.2   To the extent that it is relevant to the provision and functioning of the Payment Account, the terms located in https://paystack.com/terms are incorporated into this Agreement and will prevail over this Agreement to the extent of any inconsistency in relation to the provision of the Payment Account.

7.3   If Bookabucket decides to switch to a new Payment Provider, You may be asked to agree to any further additional terms with those providers. If you do not agree to them, you may be given alternative means of payment or denied service on the platform if there is no alternative means of payment.

 

8.   VERIFICATION & BADGES

8.1   BookABucket may use Identity Verification Services.

8.2   You agree that BookAucket Identity Verification Services may not be fully accurate as all our Identity Verification Services are dependent on information supplied by user or verification services/information provided by third parties.

8.3   BookAbucket accepts no responsibility for any use that is made of a BookAbucket Identity Verification Service.

8.4   BookAbucket Identity Verification Services may be modified at any time

8.5   BookABucket Platform includes a User-initiated review system to help evaluate Users.

8.6   Bookabucket may make Badges available to Bucketers based on the provision of certain information or documentation by the tasker. Bookabucket will determine displaying this badge upon verification by a third party verifier or issuer of the information/documentation.

8.7   You acknowledge that Badges may not be accurate at the time it is displayed as the information or documentation for issuing badges may be time-bound. You acknowledge that to the extent you relied on a Badge in entering into an Agreement, you do so aware of this limitation. You should seek to verify any Badge with the Bucekter prior to commencing the task.

8.8   It remains the Bucketer's responsibility to ensure that information or documentation it provides in obtaining a Badge is true and accurate and must inform Bookabucket immediately if a Badge is no longer valid.

8.9   BookaBucket may, at its discretion, issue Badges to Bucketers for a fee.

8.10Bookabucket retains the right to issue a Badge to a Bucketer and display it for use by the Bucketer on the BookaBucket Platform only. Any verification obtained as a result of the issue of a Badge may not be used for any other purpose outside of the BookABucket Platform.

8.11BookaBucket retains the discretion and right to not issue, or remove without notice, a Badge if You are in breach of any of the terms of this Agreement, the Badge has been issued incorrectly, obtained falsely, has expired, is no longer valid or for any other reason requiring its removal by BookaBucket.

 

9.   MODIFICATIONS TO THE AGREEMENT

9.1   Bookabucket may modify or update this Agreement or the Policies (and update the Bookabaucket pages on which they are displayed) at anytime it is required. Bookabucket will notify users upon their next login on the platform.

9.2   Amended Terms become effective immediately you actively accept to the terms. You actively accept when you perform the acceptance activity on terms or when you engage in any process that is connection to any policy or term on the platform. 

9.3   If You do not agree with any modifications to this Agreement (or any of our Policies), You must either terminate your account or You must notify Bookabucket who will terminate Your account, and stop using the platform immediately.

10.  NO AGENCY

10.1This agreement does not create an agency, partnership, joint venture, employee-employer or other similar relationship with you. In particular you have no authority to bind Bookabucket. To the extent permitted by law, Bookabucket specifically disclaims all liability for any loss or damage incurred by You in any manner due to the performance or non-performance of any Third Party Service.

 

11.  NOTICES

11.1  Except as stated otherwise, all notices must be delivered by registered ordinary post, serving organisation employee or by email, to Bookabucket contact address as displayed on the Platform. Any notice shall be deemed given:

a.    if sent by email, 24 hours after email is sent, unless the User is notified that the email address is invalid or the email is undeliverable, and

b.    if sent by pre-paid post, upon receipt of the notice at the Bookabucket contact address by an actively employed Bookabucket personnel.

11.2  Notices related to performance of any Third Party Service must be delivered to such third party as set out in the Third Party Service provider's terms and conditions.

 

12.  MEDIATION AND DISPUTE RESOLUTION

12.1  Any User may refer a dispute to Bookabucket.

12.2  Bookabucket admonishes you to seek to resolve disputes with other Users directly. Accordingly, you acknowledge and agree that in the process of dispute resolution, Bookabucket may, in its absolute discretion, provide your information as it decides is suitable to other parties involved in the dispute.

12.3  If Bookabucket provides information about other Users to You for the purposes of resolving disputes under this clause, You acknowledge and agree that such information will be used only for the purpose of resolving the dispute (and no other purpose) and that you will be responsible and liable to Bookabucket for any costs, losses or liabilities incurred by Bookabucket in relation to any claims relating to any other use of information not permitted by this Agreement.

12.4 If a dispute arises with another User, You must make yourself available physically or virtually, as may be required and co-operate with the other User and make a genuine attempt to resolve the dispute.

12.5  Bookabucket may elect to assist Users resolve disputes. You must co-operate with any investigation undertaken by Bookabucket.

12.6  Bookabucket reserves the right to make a final determination (acting reasonably) based on the information supplied by the Users and direct the Payment Provider to make payment accordingly. You may raise your dispute with the other User or Bookabucketer's determination in an applicable court or tribunal.

12.7  Bookabucket has the right to hold any Task Budget that is the subject of a dispute in the Payment Account, until the dispute has been resolved.

12.8  Bookabucket may provide access to a Third Party Dispute Service. If such a service is provided, either party may request the other party to submit to the Third Party Dispute Service if the parties have failed to resolve the dispute directly. Terms and conditions for the Third Party Dispute Service will be available on request. The Third Party Dispute Service is a Third Party Service and Users are responsible for paying any costs associated with the Third Party Dispute Service in accordance with the Third Party Dispute Service terms and conditions.

12.9  Disputes with any Third Party Service provider must proceed pursuant to any dispute resolution process set out in the terms of service of the Third Party Service provider.

 

 

13.  TERMINATION

13.1  Either You or Bookabucket may terminate your account and this Agreement at any time for any reason.

13.2  Termination of this Agreement does not affect any Task Agreement that has been formed between Bookabucket Users.

13.3  Third Party Services are conditional upon, and governed by, Third Party Service provider terms and conditions.

13.4  Sections 4 (Fees), and 12 (Mediation and Dispute Resolution) and any other terms which by their nature should continue to apply, will survive any termination or expiration of this Agreement.

13.5  If your account, this Agreement or both are terminated for any reason then You may not without Bookabucket's consent (in its absolute discretion) create any further accounts with Bookabucket and we may terminate any other accounts You operate.

 

14.  GENERAL

14.1This Agreement is governed by the Laws of the Federal Republic of Nigeria.

14.2The provisions of this Agreement are severable, and if any provision of this Agreement is held to be invalid or unenforceable, such provision may be removed and the remaining provisions will be enforceable.

14.3This Agreement may be assigned or novated by Bookabucket to a third party without your consent. In the event of an assignment or novation the User will remain bound by this Agreement.

14.4This Agreement sets out the entire understanding and agreement between the User and Bookabucket with respect to its subject matter.
